What's going on

Rentals are a big part of the local housing: 51.6% of occupied homes in the city of Dayton are renter-occupied, and 16.9% of units are vacant. Older units, long-empty units and units that turn over quickly can all hide leaks, damp basements and weak ventilation.

Public Health - Dayton & Montgomery County does not regulate mold, does not test homes, and cannot make a building owner clean up mold. It points tenants who can't reach an agreement with their landlord toward Legal Aid of Western Ohio. Ohio's landlord-tenant law is where the rules come from.

For renters

Ohio landlords must keep rentals fit and habitable and keep plumbing and HVAC working (ORC 5321.04). If they don't, Ohio law lets tenants give written notice and, if the problem isn't fixed within a reasonable time or 30 days, whichever is sooner, deposit rent with the court instead of the landlord, if they are current on rent (ORC 5321.07). There are exclusions: some small landlords who give written notice of that fact, and student tenants. This is general information, not legal advice; contact Legal Aid of Western Ohio or an Ohio attorney.

Practical steps many renters take:

  1. Document it

Take dated photos of the mold, any leak and any damaged belongings. Note when you first saw it.

  2. Tell the landlord in writing

Send written notice to the person or place where you normally pay rent, describe the problem, and keep a copy.

  3. Stay current on rent

The court deposit process under ORC 5321.07 requires it.

  4. Report code problems

City of Dayton Housing Inspection handles structural housing conditions in Dayton. Other cities have their own offices.

  5. Get advice before going to court

Talk to Legal Aid of Western Ohio or an Ohio attorney first.

Meanwhile, keep the unit as dry as you can: run fans, report leaks right away, and wipe condensation. Clean small spots with soap and water; Public Health does not recommend bleach. If anyone has symptoms, see a doctor.

For landlords and property managers

Mold in a unit is usually a water problem: a plumbing leak, a roof leak, a damp basement or a missing bath fan. Fixing the source quickly is cheaper than repeat cleanups and disputes.

  • Respond and document. Acknowledge the notice, schedule an inspection, and keep records of what was found and done.
  • Give notice before entry. Ohio law presumes 24 hours is reasonable notice in most cases.
  • Use City-registered trades. In Dayton rentals, plumbing, electrical and HVAC work must be done by a City-registered contractor.
  • Watch vacant units. Units sitting empty with the heat low or the sump unpowered can grow mold before the next tenant moves in.
  • Keep the paperwork. Invoices and clearance results help with future tenants, insurance and any sale.

Property managers with several units can describe each one in the quote form and ask companies to price them together.

Does testing help in a rental?

When mold is visible, testing usually isn't needed to know it should be fixed. There are no federal or Ohio mold limits, so a lab result can't prove a unit is "unsafe" or "safe." Where testing does help is documentation: an independent inspection report with photos and moisture readings gives both sides the same facts, and a clearance check shows the work was finished. See mold inspection and testing.

What the companies typically do

The work is the same as in an owner-occupied home: find and fix the water, contain the area, HEPA-filter the air, remove what can't be cleaned, dry the space and check the result. In occupied units, ask how they will protect the tenant's belongings and schedule around them. The full sequence is on the process page.

Fairborn and student housing

Fairborn is 48.8% renter-occupied, with many renters connected to Wright-Patterson Air Force Base and Wright State University. Ohio's rent deposit process under ORC 5321.07 doesn't apply to student tenants, so students should talk to Legal Aid of Western Ohio or an attorney about their options. See the Fairborn page.

When it's urgent

  • Active leaks, sewage backups or water near electrical.
  • Large areas of growth or wet materials that haven't dried in a day or two.
  • A tenant with asthma, a weak immune system or new symptoms. See a doctor.

Questions to ask companies

  • Can you send a certificate of insurance to the owner and the property manager?
  • Who fixes the water source, and is that plumber or HVAC contractor City-registered for Dayton rentals?
  • Will you give a written, itemized contract and a written report with photos?
  • Will there be a clearance check, ideally by an independent inspector?
  • For pre-1978 buildings, are you an EPA Lead-Safe Certified Firm, and will suspect asbestos materials be tested before tear-out?

Rental mold questions

Are landlords responsible for mold in Ohio?

Ohio law doesn't mention mold by name. ORC 5321.04 requires landlords to keep rentals fit and habitable, follow housing and health codes, and keep plumbing and HVAC working, which covers most causes of mold. This is general information, not legal advice; contact Legal Aid of Western Ohio or an Ohio attorney.

What do I do when I find mold in my apartment?

Take dated photos, tell the landlord in writing at the place you pay rent, keep a copy, and stay current on rent. City of Dayton Housing Inspection handles structural housing conditions in Dayton. This is general information, not legal advice; contact Legal Aid of Western Ohio or an Ohio attorney.

Can I pay rent to the court instead of my landlord?

Under ORC 5321.07, if written notice doesn't get the problem fixed within a reasonable time or 30 days, whichever is sooner, a tenant who is current on rent may deposit rent with the court. Some small landlords and student tenants are excluded. This is not legal advice; talk to Legal Aid of Western Ohio first.

Will Public Health inspect my rental for mold?

No. Public Health - Dayton & Montgomery County does not regulate mold, does not do in-home inspections, and cannot make an owner clean up mold. It refers tenants to Legal Aid of Western Ohio. City of Dayton Housing Inspection handles housing code conditions.

Who should hire the mold company, the tenant or the landlord?

Usually the owner, because the work involves the building and often plumbing or roofing repairs. In Dayton rentals, plumbing, electrical and HVAC work must be done by a City-registered contractor. Tenants can still request an independent inspection for their own records.
